NON-REFUNDABLE TATTOO RETAINER AGREEMENT

These terms exist to ensure clarity around booking, preparation time, and scheduling for all tattoo work.

IMPORTANT — PLEASE READ CAREFULLY

Retainers are non-refundable.

They secure appointment times and cover preparation completed in advance.

1. Retainer & Booking Fee

1.1 Any payment made to secure a tattoo appointment is a retainer or booking fee (the “Retainer”), not a deposit.


1.2 The Retainer secures the Client’s appointment and compensates the Tattoo Artist for time and resources committed in advance, including:

  • reserving the appointment date and start time;

  • preparing, designing, drawing, and planning the tattoo;

  • materials used to prepare and set up for your appointment.


1.3 Retainers are not refunded for missed appointments.

2. Grace, Rescheduling & Emergencies

The Tattoo Artist understands that unexpected circumstances can arise and approaches rescheduling and emergencies with care, transparency, and good faith, making reasonable efforts to be flexible where possible.


2.1 Rescheduling Appointments

If an appointment is requested to be cancelled or rescheduled with at least 48 hours’ written notice (email), the Retainer will remain on the Client’s account and can be applied to a future appointment. Providing appropriate notice allows the Tattoo Artist the opportunity to offer the appointment time to another client.


2.2 Transfer of Retainer

If the Client is unable to utilize the Retainer by booking a new appointment, the Retainer may be transferred to another person, provided that the cancelling or rescheduling request has been requested with at least 48 hours notice.If design work has already been prepared, a $25 CAD transfer fee will apply to compensate for time spent preparing the original design. The Client must have been notified by the Tattoo Artist via email that the design had been prepared prior to any transfer request for this fee to be requested.


2.3 Short-Notice Changes & Emergencies

Requests made with less than 48 hours’ notice may still be accommodated at the Tattoo Artist’s discretion. In these cases, the Retainer is not refunded, but may be deferred and kept on the Client’s account for use toward a future appointment.

3. Design Changes & Redesign Fees

3.1 The Retainer is attached to the originally requested design concept and appointment, regardless of whether the original design is custom-created, client-supplied, or artist's flash. 


3.2 If the Client requests a complete change to the original design concept after design work has begun, a design change fee of $25 CAD will apply.  


3.3 The design change fee:

  • does not apply if flash was the original request

  • compensates the Tattoo Artist for time spent designing the original concept;

  • is non-refundable; and

  • is not applied toward the cost of the tattoo.


3.4 Payment of the design change fee is required before any new design work begins.


3.5 Minor revisions or adjustments to an existing design concept are not considered a complete design change and do not incur a redesign fee.


3.6 Requests for a complete design change must be made no less than forty-eight (48) hours prior to the scheduled appointment to allow adequate time for redesign and preparation. If a design change request is made less than 48 hours in advance, the appointment may need to be rescheduled, subject to the rescheduling terms and notice requirements set out in this Agreement.

4. Appointment Time, Lateness & Missed Appointments

4.1 The Client confirms their scheduled tattoo appointment date and start time and agrees to arrive at the start of the appointment time, not after.


4.2 If the Client has not arrived at the appointment start time, the Tattoo Artist will attempt to contact the Client by email. A second email attempt will be made approximately 15 minutes later if the Client has still not arrived.


4.3 If the Client arrives 30 minutes or more late, a late fee will be charged at the current studio hourly rate.A third email will be sent at the 30 minute mark to update the client that there will be a late fee incurred. 


4.4 If the Client fails to arrive within 40 minutes of the appointment start time without communication, the appointment is considered missed and the Tattoo Artist may close the studio. A fourth email will be sent at the 40 minute mark updating the client of their missed appointment and that the studio will close. 


4.5 Missed appointments result in forfeiture of the Retainer. A new non-refundable booking fee is required to reschedule.

5. Alternate Payment Methods & Processing Fees

5.1 Interac e-Transfer is the preferred payment method.


5.2 If an alternate payment method is requested, an additional $5 CAD processing fee applies. WISE is being used for international clients. 


5.3 All Retainers/booking fees remain non-refundable regardless of payment method.

6. Governing Law

This Agreement is governed by the laws of the Province of British Columbia and applicable federal laws of Canada. Where services are performed outside of British Columbia, this governing law provision shall continue to apply to the fullest extent permitted by law.

7. Acknowledgement & Electronic Acceptance

By signing or electronically accepting this Agreement, the Client confirms that they have read, understood, and voluntarily agreed to all terms herein.

The Client agrees that electronic acceptance, checkbox confirmation, or electronic signature is legally binding and equivalent to a handwritten signature.
